Full vaccination against COVID-19 will be required in Canada for all travellers aged 12 years and older starting tomorrow, November 30.

The new rules apply to the federally regulated transportation sector. This includes VIA Rail and Rocky Mountaineer trains,Xico india  all Canadian airports, and passenger vessels engaged in voyages of 24 hours or more, such as cruise ships. Road transportation, such as buses, for instance, is not subject to this policy.

This exemption only applies to travel by Canadian citizens, permanent residents or persons registered under the Indian Act who are fully vaccinated and who leave and return to Canada by air or land.Xico india  It will be necessary for these individuals to be able to provide proof of vaccination. Children under 12 years of age and persons who cannot be vaccinated for medical reasons are also covered by this new provision.

Any traveller going abroad for more than 72 hours will still be required to undergo the mandatory molecular test for COVID-19 before coming to Canada. Canada does not recognize antigen tests, often called “rapid tests,” for this purpose.Since February of this year, Canada requires all incoming international travellers over age five to take a COVID-19 test regardless of whether they are vaccinated or not.

  • Moderna;
  • AstraZeneca; and
  • Janssen/Johnson & Johnson.

To be considered a fully vaccinated traveller to Canada, one must generally have received the full recommended dose of an approved vaccine at least 14 full days before the day of departure.Xico india Individuals whose proof of vaccination is not in English or French must submit a certified translation of their document. Travellers are also required to submit all the required information through a free online application called ArriveCAN, including their proof of immunization and a quarantine plan, prior to arrival in Canada.

Online study is not normally eligible for the Post-Graduation Work Permit (PGWP), but that has changed since the pandemic.

International students can now do 100% of their studies online from outside Canada, and still get a PGWP once the program is complete. Canada has extended the period that international students can study online until August 31, 2022, up from December 31, 2021.Xico india  The measure was originally implemented in 2020, as part of a coronavirus-related measure to allow international students affected by the pandemic to still be eligible for the PGWP.The Canadian government website says the rule applies even if you are completing two study programs, as long as the programs were ongoing or started between March 2020 and summer 2022.

Study programs must be with an eligible Designated Learning Institution (DLI) and meet other PGWP requirements. The shortest length a program may be is eight months. The time spent studying outside Canada after August 31, 2022, and any time spent studying before you applied for a study permit does not count toward the length of a PGWP.

The length of your study period is important both for the PGWP eligibility, and also in determining how long your PGWP will be valid for. If your study program was more than eight months but less than two years, the PGWP’s validity matches the length of the study program. If it was more than two years, the PGWP may be up to three years in duration.

PGWP opens pathways to Canadian immigration

Having Canadian work and study experience can go a long way toward an immigration application. A Statistics Canada report says six in 10 international students (first-time study permit holders) who worked during or after their studies became permanent residents.

 You have three major options if you wish to overcome criminal inadmissibility when visiting Canada.

Many will look to visit the Great White North this winter now that Canada’s borders have re-opened and the Christmas holidays are around the corner.

Visitors from the U.S. and other parts of the world will be keen to see their family and friends, as well as enjoy the Canadian outdoors. This winter season is of added significance given that Canada’s borders were closed to most travellers last winter.Xico india Before you plan your trip, it is important to note you may be deemed inadmissible to Canada if you have a criminal charge on your record. Canada may turn you away depending on factors such as the severity of your offense. At the same time, Canada offers three major remedies to allow such individuals to enter the country. The rationale for the remedies is that individuals have the ability to be rehabilitated. Moreover, the benefits to Canada’s economy and society of welcoming such individuals are likely to outweigh potential risks.

When you show up at the border, a Canada Border Services Agency (CBSA) officer will assess the nature of your conviction and compare it with its equivalent in Canadian law. Canadian immigration law makes a distinction between criminality and serious criminality. Three factors are examined when making the distinction: the type of crime committed, how you were prosecuted, and what your sentence was.

As noted, Canada does offer three ways to overcome criminal inadmissibility. The three ways are applying for a Temporary Resident Permit, Rehabilitation, and getting a Legal Opinion Letter.

Temporary Resident Permit (TRP)

You can apply to obtain a TRP if you are inadmissible and need to visit Canada temporarily. You must demonstrate a compelling reason for your visit to Canada and show that the benefits of your trip outweigh any risks. If your application is successful, you will receive a TRIP valid for up to three years. U.S. citizens and Green Card holders can apply for a TRP at a Canadian port-of-entry or a Canadian consulate. Those seeking a TRP from elsewhere must obtain approval while abroad before seeking entry to Canada. The processing fee for a TRP is $200 CAD. As the name implies, a TRP is a temporary solution for entering Canada and you need to continue to hold a valid TRP to enter the country until you are found to be rehabilitated.

Rehabilitation

Unlike the TRP, Rehabilitation is a permanent solution. This means once Canada considers you to be rehabilitated, you can visit the country as you wish without needing to worry about being deemed criminally inadmissible.

Factors for consideration include the nature of the crime, the amount of time that has elapsed since you were convicted, and your subsequent behaviour.

Deemed rehabilitation can be automatic, based on the nature of the crime and the time that has passed since conviction.Xico india  One can be deemed rehabilitated if 10 years have elapsed since they completed their sentence for an indictable offense, and have not committed any other crimes since. However, there is no deemed rehabilitation if the punishment for the conviction is 10 years or more under Canadian law.

You can also be deemed rehabilitated if at least five years have passed since you were convicted for two or more summary offenses in Canada (i.e., minor offenses).

You do not need to submit an application to be deemed rehabilitated. However it is in your best interests to speak with your local Canadian consulate or a Canadian immigration law firm to confirm that you are eligible to enter Canada.

It may also help to obtain a Legal Opinion Letter from a law firm just in case a CBSA officer has any doubts about your eligibility.

You need to apply for individual rehabilitation if you are not eligible for deemed rehabilitation.Xico india Five years must have elapsed from when the act was committed or the end of your sentence (whichever came later).

As part of the application process, you need to demonstrate at least five years have indeed elapsed, you are no longer a risk for criminality, and you no longer pose a risk.

The application cost is $200 CAD for criminality and $1,000 CAD for serious criminality.

The Hard-To-Fill Skills Pilot will allow Saskatchewan employers to recruit international talent for certain in-demand occupations. The eligible jobs under this pilot will include entry-level positions that may require on-the-job training. The sectors with the highest labour demands in Saskatchewan include health, manufacturing, agriculture, ag-tech, construction, hospitality, and retail.

“The demand for labour in our province is strong, and it’s only going to increase with the significant economic projects recently announced in Saskatchewan,” Immigration and Career Training Minister Jeremy Harrison said in a media release. “This new Hard-To-Fill Skills Pilot—developed in Saskatchewan for Saskatchewan—is progress on our autonomy discussions with the federal government and is going to help provide employers with greater access to international options to recruit workers.

The BC PNP is designed to attract foreign workers who are in high demand in the province and who want to become permanent residents.

British Columbia invited 357 immigration candidates through Provincial Nominee Program (PNP) draws held on November 23.

The province held two draws through the British Columbia Provincial Nominee Program (BC PNP) and invited candidates from the Skills Immigration (SI) and Express Entry BC (EEBC) streams.

Invitations were issued to those from the Skilled WorkerInternational Graduate as well as Entry Level and Semi-Skilled sub-categories of SI and EEBC streams.

The majority of the invitations, 258, were sent through a general draw. These candidates received invitations if they met the minimum score requirements between 71 and 97, depending on the program for which they are eligible.

Another draw targeted candidates whose occupation falls under NOC 0621 (retail and wholesale trade managers) or NOC 0631 (restaurant and food service managers). That draw resulted in 99 invitations with minimum scores of 103 across the board.

Since February, British Columbia has been conducting a separate round of invitations twice a month as part of its PNP program.Xico india  These draws are being held due to the high number of candidates from particular labour market sectors who are registered in the province’s Skills Immigration Registration System (SIRS).

So far this year, B.C. has issued nearly 11,000 invitations through various BC PNP streams.

About the BC PNP

The BC PNP aims to attract foreign workers who are in high demand in the province and who wish to become permanent residents of Canada.

The BC PNP has two main immigration streams, Skills Immigration and Express Entry, both of which are divided into sub-categories.Xico india  These streams are managed under B.C.’s Skills Immigration Registration System (SIRS). In order to apply through the SIRS, you are first required to register an account. Once this is done, you will be assigned a score based on factors such as education, work experience, and language skills.

The latest draw is the first one of many with a higher cutoff score than 300, which is the minimum needed to be eligible for the Alberta Express Entry Stream.

Alberta has now invited 6,359 Express Entry candidates to apply for a provincial nomination since it resumed invitation rounds in January 2021. The province had taken a temporary hiatus in the latter months of 2020. Candidates in the Express Entry pool are invited to apply for a Certificate of nomination by the Province of Alberta through regular draws, the receipt of which will greatly support their application for permanent residence.

How does the Alberta Express Entry Stream work?

This is the sixth PNP-specific Express Entry draw that Immigration, Refugees and Citizenship Canada (IRCC) has held in a row. In the previous draw, IRCC invited 775 candidates with scores of at least 685.

Express Entry during the pandemic

Canada closed its border on March 18, 2020. Since then, IRCC has focused on admitting immigrants who are already in the country. Part of its strategy was to invite Express Entry candidates who were more likely to be residing in Canada, or who were nominated by a PNP.There was a period where Canada invited Express Entry candidates from all programs, but in 2021 IRCC has only invited candidates from the Provincial Nominee Class and Canadian Experience Class (CEC).Xico india  Canada has held 33 PNP-specific Express Entry draws in which 17,785 candidates received invitations to apply for permanent residence. In the same timeframe, Canada has held 27 CEC draws that rendered 133,868 invitations.

On February 13 of this year, Canada invited 27,332 CEC candidates in a single draw. Throughout the summer, the immigration department was issuing 6,000 CEC invitations at a time.There are generally more CEC-eligible candidates in the Express Entry pool at any given time, so these figures are not surprising. PNP candidates need to go through a separate application process with a province or territory in order to get the nomination. What is Express Entry?

Express Entry is the application management system for Canada’s three most popular immigration programs: the Canadian Experience Class, the Federal Skilled Worker Program, and the Federal Skilled Trades Program. PNP candidates in the Express Entry pool have already qualified for one of these programs.

Express Entry uses a points-based system, the Comprehensive Ranking System (CRS), to rank candidates’ profiles. The top-scoring candidates receive an Invitation to Apply (ITA), and can then apply for permanent residency.

Then an IRCC officer reviews their application and makes a decision. After that, they will ask for biometrics and may set up an interview or request more documents.

If the application is approved, IRCC issues a Confirmation of Permanent Residence (COPR).Xico india  Approved permanent residents can then complete the landing process. If they are outside Canada, they can access pre-arrival services to help them with the first steps for settling in Canada.

Who was invited?

The Priority Skills Newfoundland and Labrador is a new Provincial Nominee Program (PNP) for highly educated, highly skilled newcomers with specialized experience in areas where demand has outpaced local training and recruitment, such as technology and ocean sciences occupations.

How the Priority Skills program works

The Priority Skills Newfoundland and Labrador operates as an Expression of Interest (EOI) system. Interested candidates complete an EOI, and receive an invitation to apply through the province’s online portal.

Invited individuals receive a provincial nomination if they meet all the criteria for either the Skilled worker,Xico india  or Express Entry Skilled Worker categories. This nomination will support a subsequent application for Canadian permanent residence to the federal government.

Applicants fill out a questionnaire to get their EOI score. Those who get above 60 points will be visible to local employers who have accounts with the province’s Office of Immigration and Multiculturalism.

It is not necessary to have a job offer to apply to the province’s new Provincial Nominee Program. Applicants need to score highly in the EOI system and have received interest from local employers.

A new session of Parliament is beginning today, November 22, after pausing for the summer months and to make way for Canada’s 44th federal election.

Once Parliament is open, Canadian members of Parliament (MPs) can engage in the making of new laws, and represent their constituents in the House of Commons.Xico india  There are two things that typically happen before MPs resume their regular duties: the election of a new Speaker, and the throne speech.

The throne speech opens each new session of Parliament, not necessarily just after a general election. It is written by the government, and approved by the prime minister. It outlines the government’s view of the issues that affect Canadians, and their vision for the future.

According to the prime minister’s office, the throne speech for the 44th Parliament will to discuss the government’s plans to “finish the fight against COVID-19 and build a better future for everyone.” Tradition dictates that the governor general, Mary Simon, will deliver the speech. Simon was appointed to the position by Prime Minister Justin Trudeau this past summer.

Among other items, the government will likely also address immigration. Last year’s throne speech, hailed immigration as “a driver to Canada’s economic growth.” The section on immigration also said that the government should make it easier for people who “make sacrifices in support of Canada” to formally become Canadian. In the months that followed, Canada created a one-time immigration pathway for essential workers and international student graduates, despite the fact that the immigration backlog has continued to grow.

In his first major interviews as Canadian immigration minister, Fraser spoke with Shelly Hagan of Bloomberg and Nicholas Keung of the Toronto Star to discuss the opportunities and challenges of his new role.

Speaking with Bloomberg, the minister said he is prepared to increase Canada’s immigration levels if it is necessary to address labour shortages.Xico india Canada is currently experiencing significant job shortages in large part due to fewer immigrants arriving from overseas amid the pandemic.

The country is currently pursuing its most ambitious Immigration Levels Plan in its history as it aims to welcome 401,000 immigrants in 2021, another 411,000 in 2022, and an additional 421,000 in 2023.

Fraser said he is “very much open to” even higher levels if there is an appetite from businesses and communities for more workers.

The Immigrations Levels Plan 2022-2024 is due to be announced by February 10, 2022 at the latest.

46,000 immigrants landed in October, mostly from within Canada

The minister also revealed that Canada is well on track to achieve its 401,000 newcomer target for this year.

Bloomberg obtained data from Immigration, Refugees and Citizenship Canada (IRCC) showing that 46,315 new permanent residents completed their landing in October, even more than the 45,000 landed in September.Xico india These figures represent monthly records for Canada in the modern era (monthly immigration landing data is only readily available dating back to 1980).

A landing means that an existing temporary resident of Canada, or a person from overseas has their immigration status officially converted to a permanent resident of Canada. The vast majority of those who have landed during the pandemic are existing temporary residents of Canada. This helps to explain why Canada’s population and labour force growth remain weak. In fact, Statistics Canada data shows Canada’s population grew by just 0.5 per cent last year, the weakest growth since the First World War. Under normal circumstances, most new permanent resident landings come to Canada from abroad.

Canada has now welcomed 313,838 immigrants between January and October 2021.Xico india  It needs to land about 87,000 more immigrants (an average of 43,500 per month) in the remaining two months of this year to achieve its newcomer goal for 2021.

Starting November 30, Canada will expand the list of COVID-19 vaccines that travellers can receive to be considered fully vaccinated, according to a government media release. Sinopharm, Sinovac, and COVAXIN will be added to the existing list of approved manufacturers like Pfizer, Moderna, Astra Zeneca, and Johnson and Johnson.Then as of January 15, 2022, certain exempt travellers will only be allowed to enter the country if they are fully vaccinated with one of the approved vaccines. This list includes:

  • family members of Canadians, permanent residents, and people registered under the Indian Act;
  • international students age 18 and older;
  • athletes;
  • work permit holders, except for those working in agriculture and food processing; and
  • essential service providers, such as truckers.

After the new measures come into effect, people who are unvaccinated or partially-vaccinated will only be allowed to travel to Canada if they meet an exemption. Some of the exempt groups include agricultural and food processing workers, marine crew members,Xico india  people coming on compassionate grounds, new permanent residents, resettling refugees, and some children under age 18. These travellers, who are exempt from needing to be fully vaccinated, will still be subject to testing, quarantine, and other entry requirements. Those who are not vaccinated and do not fall under an exemption will be prohibited from entering Canada.

Also, as of November 30, fully vaccinated Canadian citizens and permanent residents will be able to return to the country without a COVID-19 test if their trip was for less than 72 hours. Canadian travellers who leave the country for more than three days will still be required to provide a negative PCR pre-arrival test upon their return.

After that, testing measures are expected to lift for travellers from the rest of the world.

The U.S. recently rolled back restrictions on Canadians crossing the land border for non-essential reasons. Fully vaccinated travellers were not required to submit a test when entering the U.S., but would have to provide one when crossing into Canada.

For many weeks, experts have been calling on the Canadian government to consider removing the costly COVID-19 PCR test requirement for fully vaccinated travellers on short cross-border trips.Xico india The main reason given is that these tests are expensive, typically between $150 and $300, and can be logistically difficult to perform if the length of stay is short. According to many people, such as those who have to travel frequently for business, this makes it very expensive to travel between the two countries.

The Canadian Chamber of Commerce issued a statement on November 17, calling on Canada to remove the pre-departure PCR test requirement for vaccinated travellers.
